TERMS AND CONDITIONS OF USE — YESSOUA

1. About Yessoua

Welcome to Yessoua, an African real estate platform developed and operated by Clyktech, a technology company based in Côte d'Ivoire.

Yessoua aims to make real estate information more accessible and to connect people looking for properties with owners, real estate agents, agencies, developers, and other real estate professionals.

The platform is designed for African real estate markets and is intended to progressively expand across several countries, particularly within the Economic Community of West African States (ECOWAS) and the West African Economic and Monetary Union (WAEMU).

Yessoua may allow users to:

  • search for properties;

  • view property listings;

  • publish properties;

  • manage listings;

  • search for properties using maps;

  • contact advertisers;

  • request or arrange property visits where this functionality is available;

  • use features designed for owners, agents, agencies, and real estate professionals.

These Terms and Conditions of Use ("Terms") govern your use of the Yessoua mobile application, website, and related services.

By using Yessoua, creating an account, or publishing a listing, you acknowledge that you have read and accepted these Terms.

If you do not agree with these Terms, you must not use Yessoua.

2. Definitions

For the purposes of these Terms:

"Yessoua", "the Platform", "the Application", or "the Service" means the Yessoua mobile application, website, and related services operated under the Yessoua brand.

"Clyktech", "we", "us", or "our" means the company developing and operating Yessoua.

"User", "you", or "your" means any person using Yessoua.

"Listing" means any publication relating to a real estate property.

"Advertiser" means any person publishing a listing on Yessoua.

"Owner" means a person claiming to own a property or to have the necessary rights to offer it.

"Professional" means, in particular, a real estate agent, agency, developer, company, or other professional using Yessoua.

3. Acceptance of the Terms

Your use of Yessoua is subject to these Terms and our Privacy Policy.

Certain features may also be subject to additional terms, which may be presented to you before you use or purchase those features.

By using Yessoua, you agree to comply with:

  • these Terms;

  • our Privacy Policy;

  • our listing rules;

  • all laws and regulations applicable to you.

4. Account and Registration Requirements

Certain Yessoua features require you to create an account.

When registering, you must provide accurate, complete, and up-to-date information.

You agree not to:

  • use a false identity;

  • impersonate another person;

  • create an account for the purpose of deceiving other users;

  • provide intentionally false information;

  • share your account with unauthorized persons;

  • allow another person to use your account in a manner that violates these Terms.

You are responsible for activities carried out through your account, except where Clyktech is legally responsible.

5. Minimum Age

Use of certain Yessoua features may be subject to a minimum age requirement under the laws applicable in the user's country.

Where a specific minimum age is required for a feature or service, the user must comply with that requirement.

We may take appropriate action where an account appears to have been created in violation of applicable age requirements.

6. Permitted Use of Yessoua

You must use Yessoua only for lawful purposes and in accordance with these Terms.

You must not:

  • knowingly publish false information;

  • publish a property without having the necessary rights or authorization;

  • create fake listings;

  • publish a non-existent property;

  • advertise a property that has already been sold or rented as still being available;

  • use misleading or unauthorized photographs;

  • use another person's photographs without authorization;

  • impersonate an owner, agent, agency, or professional;

  • defraud or attempt to defraud another user;

  • use Yessoua for money laundering or other unlawful activities;

  • misuse information obtained through Yessoua;

  • collect or extract platform data without authorization;

  • bypass security systems;

  • attempt to access another user's account;

  • introduce viruses, malware, or harmful code;

  • interfere with the operation of Yessoua;

  • harass, threaten, abuse, or deceive other users;

  • use Yessoua in violation of applicable laws.

7. Publishing Real Estate Listings

Authorized users may publish real estate listings.

The advertiser is solely responsible for the information contained in their listing.

The advertiser must provide information that is as accurate, complete, and current as reasonably possible.

A listing may include:

  • property type;

  • price;

  • location;

  • description;

  • photographs;

  • videos;

  • property features;

  • availability;

  • contact information;

  • owner or professional information.

8. Accuracy and Updating of Listings

Advertisers must keep their listings up to date.

If a property has been:

  • sold;

  • rented;

  • reserved;

  • withdrawn from the market;

  • otherwise become unavailable;

the advertiser must update or remove the listing within a reasonable period.

Yessoua may also remove or disable a listing that appears to be outdated, misleading, fraudulent, unlawful, or contrary to these Terms.

9. Advertiser Responsibility

The advertiser represents that they have the necessary rights or authorization to publish the listing.

The advertiser is responsible for:

  • the accuracy of the information provided;

  • photographs and videos;

  • property availability;

  • advertised price;

  • property description;

  • legality of the offer;

  • contact information;

  • commitments made to other users.

Publication of a listing on Yessoua does not automatically constitute certification of ownership or legal status of the property.

10. Property Verification

Yessoua may implement systems for:

  • account verification;

  • listing verification;

  • reporting;

  • moderation;

  • document verification;

  • suspicious activity detection.

However, unless a specific verification service is expressly identified as such, any verification performed by Yessoua must not be considered an absolute guarantee of:

  • ownership;

  • availability;

  • authenticity;

  • legal compliance;

  • property quality;

  • property value;

  • physical condition;

  • land or title status.

Users must conduct their own due diligence before entering into any transaction.

11. Role of Yessoua

Yessoua is a technology platform.

Unless expressly stated otherwise, Yessoua is not:

  • the owner of properties listed on the platform;

  • the seller of listed properties;

  • the landlord;

  • the buyer;

  • the real estate agent representing every listing;

  • a notary;

  • a lawyer;

  • a land surveyor;

  • an expert acting on behalf of the user;

  • a guarantor of transactions between users.

A listing published on Yessoua does not mean that Clyktech owns, controls, or legally represents the relevant property.

12. Relationships Between Users

Users are responsible for their interactions with other users.

Yessoua may facilitate communication or contact but does not automatically become a party to the contractual relationship between:

  • owner and tenant;

  • seller and buyer;

  • agent and client;

  • landlord and tenant;

  • professional and prospective customer.

All transactions must comply with applicable laws.

13. Property Visits

Yessoua may allow users to request or arrange property visits.

Unless a specific property-visit service is directly provided by Yessoua, Clyktech is not responsible for the physical organization of the visit or for the conduct of participants.

Before attending a property visit, users are encouraged to:

  • verify the identity of the person they are meeting;

  • verify the property address and information;

  • avoid unnecessarily sharing sensitive documents;

  • avoid making rushed payments;

  • report suspicious behavior.

Yessoua does not guarantee that a property advertised as available will remain available at the time of the visit.

14. Payments and Transactions

Some Yessoua features may be free while others may be paid.

Where a feature allows payment directly through the platform, the applicable conditions will be presented before payment.

Where a real estate transaction takes place directly between users outside Yessoua, Clyktech is not a party to that transaction.

Yessoua does not guarantee:

  • completion of a sale;

  • completion of a rental;

  • delivery or handover of a property;

  • repayment of money sent directly to another user;

  • authenticity of documents provided by a user.

Users should conduct appropriate due diligence before transferring significant amounts of money.

15. Fraud Prevention

Yessoua may implement mechanisms designed to detect suspicious activities.

Where there are reasonable grounds to suspect fraud or abuse, we may:

  • suspend a listing;

  • remove a listing;

  • suspend an account;

  • restrict certain features;

  • request additional documents;

  • request additional information;

  • temporarily restrict certain actions;

  • retain information necessary for security and fraud prevention;

  • cooperate with competent authorities where legally required.

16. Reporting

Users may report a listing or behavior they believe to be:

  • fraudulent;

  • misleading;

  • unlawful;

  • dangerous;

  • abusive;

  • contrary to these Terms.

After receiving a report, we may review the available information and take appropriate action.

17. User-Generated Content

Users remain responsible for the content they publish.

This includes:

  • text;

  • photographs;

  • videos;

  • documents;

  • property descriptions;

  • other information.

You must have the necessary rights and permissions to publish such content.

You must not publish content that:

  • infringes copyright;

  • violates another person's privacy;

  • contains personal information published without authorization;

  • is fraudulent;

  • is defamatory;

  • is unlawful;

  • is intentionally misleading;

  • infringes the rights of third parties.

18. License Granted to Yessoua

When you publish content on Yessoua, you grant Clyktech a non-exclusive, worldwide, royalty-free license, limited to the period and purposes reasonably necessary to operate the service, to:

  • host the content;

  • store the content;

  • display the content;

  • reproduce the content where technically necessary;

  • distribute the content within Yessoua;

  • technically adapt the content for display on different devices and formats.

This license does not transfer ownership of your content to Clyktech.

19. Intellectual Property

The Yessoua name, logo, interface, design, features, source code, databases, graphics, and other elements developed or owned by Clyktech are protected by applicable intellectual property laws.

Unless expressly authorized in writing, you may not:

  • copy the application;

  • reproduce its interface;

  • copy its source code;

  • modify proprietary elements;

  • resell its features;

  • systematically reproduce or extract its data;

  • use the Yessoua brand in a way that creates confusion;

  • create a derivative service based on protected Yessoua elements.

20. Mapping and Location Services

Yessoua may use mapping and location services.

Geographic information displayed on the platform may be approximate.

A location displayed on a map does not necessarily constitute legal proof of:

  • ownership;

  • land boundaries;

  • property area;

  • legal address;

  • cadastral status.

Users must conduct the necessary administrative and land-related checks with competent authorities or qualified professionals.

21. Third-Party Services

Yessoua may use third-party services for purposes including:

  • mapping;

  • hosting;

  • storage;

  • authentication;

  • notifications;

  • analytics;

  • payments;

  • security;

  • communication.

Such services may be subject to their own terms and privacy policies.

22. Service Availability

We make reasonable efforts to keep Yessoua available.

However, we do not guarantee uninterrupted or permanent availability.

The service may temporarily become unavailable due to:

  • maintenance;

  • updates;

  • technical incidents;

  • network failures;

  • provider outages;

  • security incidents;

  • circumstances beyond our reasonable control.

23. Accuracy of Platform Information

Some information available on Yessoua is provided directly by users or obtained from third-party sources.

We make reasonable efforts to improve the quality and reliability of the information available through the platform, but we do not guarantee that all information is:

  • accurate;

  • complete;

  • current;

  • available;

  • error-free.

24. Limitation of Liability

To the maximum extent permitted by applicable law, Clyktech shall not be liable for damages or losses arising from or related to:

  • false listings;

  • fraud committed by a user;

  • transactions between users;

  • payments made directly to users;

  • unavailable properties;

  • changes in advertised prices;

  • property visits;

  • conduct of users;

  • information supplied by third parties;

  • service interruptions;

  • failures of third-party services;

  • reliance on information available through Yessoua.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

25. Security

We implement reasonable measures designed to protect Yessoua and the information processed through the platform.

However, no information system can guarantee absolute security.

Users are also responsible for:

  • protecting their login credentials;

  • using an appropriate password;

  • not sharing account credentials;

  • promptly reporting suspicious activity.

26. Personal Data Protection

The collection and use of personal data are governed by our Privacy Policy.

As Clyktech is based in Côte d'Ivoire, Yessoua takes into account applicable data-protection requirements in Côte d'Ivoire.

However, because Yessoua is intended for multiple African markets and may be used by people located in different countries, additional laws and regulations may apply depending on the user's country of residence or use of the service.

Where specific legal requirements apply to a user, we seek to comply with the obligations applicable to the relevant processing activities.

27. Paid Services and Subscriptions

Certain features may be offered through:

  • one-time purchases;

  • subscriptions;

  • credits;

  • promoted listings;

  • professional services;

  • premium features.

Before making a purchase, the applicable price, currency, duration, and relevant conditions will be displayed where applicable.

Refund and cancellation conditions may depend on the service concerned and the laws applicable in the user's jurisdiction.

28. Advertising and Promoted Listings

Yessoua may offer advertising or listing-promotion services.

A promoted listing may receive increased visibility, but promotion does not constitute a guarantee regarding:

  • property quality;

  • ownership;

  • availability;

  • legal compliance;

  • profitability;

  • completion of a transaction.

29. Account Suspension and Termination

Clyktech may suspend or terminate an account where there are reasonable grounds to believe that the user:

  • violates these Terms;

  • publishes false information;

  • participates in fraudulent activity;

  • puts other users at risk;

  • infringes third-party rights;

  • compromises the security of Yessoua;

  • uses the service for unlawful purposes.

Where appropriate and legally permitted, the user may be informed of the reason for the action.

30. Removal of Listings

We may remove, hide, modify, or disable a listing when reasonably necessary to:

  • comply with applicable law;

  • protect users;

  • prevent fraud;

  • respond to reports;

  • protect third-party rights;

  • maintain the quality and integrity of Yessoua;

  • enforce these Terms.

31. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, costs, or expenses arising directly from:

  • your violation of these Terms;

  • your unlawful use of Yessoua;

  • content you publish;

  • false statements or representations;

  • infringement of third-party rights;

  • fraudulent activity carried out through your account.

This provision applies only to the extent permitted by applicable law.

32. Force Majeure

Clyktech shall not be liable for events beyond its reasonable control, including:

  • natural disasters;

  • floods;

  • fires;

  • major infrastructure failures;

  • network outages;

  • cyberattacks;

  • provider failures;

  • governmental or administrative decisions;

  • conflicts;

  • civil unrest;

  • telecommunications failures;

  • infrastructure disruptions;

  • other events beyond Clyktech's reasonable control.

33. Governing Law and Jurisdiction

Because Clyktech is established in Côte d'Ivoire, the relationship between Clyktech and users shall, to the extent permitted by applicable law, be governed by the laws applicable to Clyktech's place of establishment.

However, this provision does not deprive users of mandatory protections granted to them under the laws of their country of residence where those protections are applicable.

The parties are encouraged to seek an amicable resolution before initiating formal proceedings.

Where necessary, disputes shall be submitted to the competent courts in accordance with applicable jurisdiction rules.

34. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The affected provision shall, where legally possible, be interpreted or replaced in a manner that best preserves its original purpose.

35. No Waiver

If Clyktech does not immediately enforce a right or provision under these Terms, this does not constitute a waiver of that right or provision.

36. Changes to These Terms

Clyktech may modify these Terms to:

  • introduce new features;

  • improve the service;

  • modify paid services;

  • comply with regulatory changes;

  • strengthen security;

  • adapt Yessoua to different African markets.

The updated version will be published on Yessoua together with its effective or update date.

Where required by applicable law, users will be notified of material changes.
